BOARD OF SUPERVISORS MEETING
September 8, 2010 Minutes
I. CALL TO ORDER
1. Chairman Bartel called the meeting to order at 7:03 P.M.
2. Present:
Acting Chairperson Tom Sykora until Lester A. Bartel, Jr. arrived at 8:44 pm and took his seat as Chairman

II. ASSURANCE OF PROPER NOTICE
4. Town Clerk Jessica Schmidt assured the meeting was noticed properly
II. PLEDGE OF ALLEGIANCE TO THE FLAG
III. ADOPTION OF AGENDA
1. Clerk Schmidt requested to strike item F under new business from the agenda as this item will be discussed in closed session at a later date.
2. ACTION: Supervisor Grabow moved to accept agenda as amended, seconded by Supervisor Schaefer. Motion carried 4-0
IV. REVIEW & APPROVE MINUTES
1. ACTION: Supervisor Grabow moved to accept the minutes of the previous meeting, seconded by Supervisor Schaefer. Motion carried 3-1, with Nancy Rogers dissenting as she was absent
V. PUBLIC HEARINGS
A. Conditional Use Permit for an addition-Chris & Joy Kalt-775 Lancaster-tax key # 06-009-10-006.00
1. Action-Chairman Sykora opened the public hearing at 7:05 pm
2. Planner Schaefer and Engineer Lundeen explained that staff has reviewed this application and recommend approval. Initially staff was concerned about the project going into the C-1 overlay on the site, however after review, this project will not affect the overlay and there are no issues. The public hearing is being held tonight as the newspaper made a mistake with the publication dates.
3. No one wished to speak
4. Action-Chairman Sykora closed the public hearing at 7:07 pm
5. Action- No action needed as it was approved at the Plan Commission meeting pending the public hearing tonight.

VII. OLD BUSINESS
A. Update on Nuisance Violation-Steven Smith-1831 HWY W-tax key# 06-007-13-005.00
1. Clerk Schmidt stated that the site continues to be cleaned. The Board needs to take action tonight to approve, deny or extend the opportunity to come into compliance.
2. Supervisor Grabow requested that a final list be drafted to be followed in order to close the project out. The site needs to be re-inspected anyway, so this list could be made at that time.
3. Supervisor Grabow requested Engineer Lundeen inspect the berm on the site and report at the October meeting. Staff will verify if a berm permit was taken out. This is a separate item that will appear on the agenda next month for discussion and possible action.
4. Action-Supervisor Grabow moved to table this item until the October 13, 2010 Board meeting to allow a site inspection by the Building Inspector and Supervisor Grabow to establish a list of remaining nuisance items that need to be addressed, seconded by Supervisor Rogers. Motion carried 4-0
B. Nuisance Violation Closure-Dennis Kratz-1920 Ulao Pkwy-tax key # 06-009-09-005.00
1. At the August meeting, the Board directed staff to issue a closure letter for the violation. Staff is requesting formal action by the Board to officially close the file.
2. Action-Supervisor Grabow moved to close the violation, seconded by Supervisor Rogers. Motion carried 4-0
C. Update on Plan of Reparation-Rich Wieland-Woodland Shores
1. Mr. Wieland is not in attendance at the meeting this evening. Staff marked up the pavement as the developer requested, but has not heard back from him since. The Board extended the opportunity to cure for the developer to have all work completed by October 13, 2010.
2. No action taken
D. Direction from the Board of Supervisors to allow staff to begin the Comprehensive Plan amendment process per the outcome of the STH 32 Land Use Update
1. Action-Supervisor Schaefer moved to direct staff to begin the amendment, seconded by Supervisor Rogers. Motion carried 4-0
E. Town Release of Guarantee Bond for Pioneer Preserve Subdivision
1. Action-Supervisor Rogers moved to release the Guarantee Bond in the amount of $24,086, seconded by Supervisor Schaefer. Motion carried 4-0
VIII. NEW BUSINESS
A. Procedures for action regarding Concrete Driveways installed in the Town’s Right-of-way
1. Action-Supervisor Grabow moved to table this item until the October meeting and to direct staff to prepare draft text, seconded by Supervisor Schaefer. Motion carried 4-0
B. Drainage Project Update
1. The Green Valley Road project: it has been determined that there are navigable waterways on site. The Town will have to obtain a dredging permit to complete the work.
2. Falls Road project: Tentative schedule is to have documents available in February and bid opening and award in March. With work to be started in April.
3. Edgewater Drainage easement: still waiting for Chairman Bartel to meet with the property owner
C. Eradication of noxious weeds in the Town’s Right-of-way
1. Action-Supervisor Schaefer moved to direct staff to prepare draft text and research adjacent municipalities and present it at the October meeting, seconded by Supervisor Grabow. Motion carried 4-0
D. Presentation of Codified STH 32 Components
1. Attorney Hahn stated that there are issues with updating the references in the Word version of the text. The actual text has been adopted; we are just waiting on the paper versions to be distributed.
2. No action taken.
E. Establish a date for the Budget Workshop
1. The first budget workshop date is set for October 20, 2010 at 7:00 PM
F. Lease renewal terms for Town Hall office and meeting room (Current lease expires December 31, 2010)
1. This item was stricken form the agenda, no action taken
G. Renewal of Assessor contract with Grota Appraisals for a two-year tem Beginning January 1, 2011 and ending December 31, 2013
1. Action-Supervisor Rogers moved to renew the contract with Grota for a 2-year term, seconded by Supervisor Schaefer. Motion carried 4-0
H. Draft Ordinance 2010-7 regarding abatement of trash and rubbish in foreclosed homes/abandoned property
1. Action-Supervisor Schaefer moved to direct staff to schedule the public hearing for next month, seconded by Supervisor Rogers. Motion carried 4-0
IX. TOWN STAFF UPDATES
A. Engineer
1. Thanks for those who attended the non-motorized boat launch ribbon cutting ceremony
2. Multi Use Trail project final completion date is November 15th
3. Multi Use Trail phase 2 grant has not been awarded to the Town of Grafton at this time but can be applied for in the next cycle
4. Road project budget-staff directed the County to complete paving projects so the Town could utilize the pavement credit
B. Planner
1. Blue Sky School of Massage site plan was approved over a year ago, mound installed in incorrect location, buffer yard, mound pushed to ROW and they are working with staff to re-do their landscaping plan
C. Legal
1. Jetzco has agreed on a zoning classification
D. Weed Commissioner
1. Take into account open areas in subdivisions that are not being maintained
2. Chairman Bartel took his seat at 8:44 pm

3. Supervisor Schaefer stated that there are pine trees in the Right-of-way that are blocking the stop sign on Ulao Rd and Lakeshore Rd (499)

XII. MISCELLANEOUS ITEMS DEEMED PERTINENT AS ALLOWED BY LAW
1. None
XIII. CONVENE INTO CLOSED SESSION – PURSUANT TO SECTION §19.85(1) (G), WIS. STATS, TO CONFER WITH THE TOWN’S LEGAL COUNSEL REGARDING LEGAL STRATEGY TO BE CONSIDERED BY THE TOWN BOARD REGARDING POTENTIAL LITIGATION CONCERNING THE DENOW LANDFILL
1. Action-Supervisor Grabow moved to convene into closed session, seconded by Supervisor Sykora. Motion carried 5-0
1) RETURN TO OPEN SESSION – PURSUANT TO WIS. STATS §19.85 (2) FOR ADDITIONAL DISCUSSION, EVALUATION, AND PREPARATION OF LEGAL ACTION REGARDING THE DENOW LANDFILL
1. Action-Supervisor Sykora moved to return to open session, seconded by Supervisor Grabow. Motion carried 5-0
XIV. ADJOURN
1. Action – Motion made by Supervisor Sykora to adjourn. Seconded by Supervisor Rogers. Motion carried 5-0
