BOARD OF SUPERVISORS MEETING

I. CALL TO ORDER
A. Chairman Bartel called the meeting to order at 7:02 PM.
B. Present:

II. ASSURANCE OF PROPER NOTICE
A. Town Clerk Erica Raffaele assured the meeting was noticed properly.
III. PLEDGE OF ALLEGIANCE TO THE FLAG
IV. REVIEW AND ADOPT AGENDA
A. ACTION: Supervisor Grabow moved to approve the agenda after adding Mr. Chris Atkins to Item B under New Business. Supervisor Sykora seconded the motion. Motion carries 4-0.
V. APPROVE MINUTES FROM PREVIOUS MEETING
A. ACTION: Supervisor Grabow moved to approve the minutes as presented. Supervisor Stockwell seconded the motion. Motion carries 4-0.
VI. PUBLIC HEARINGS - OPPORTUNITY WILL BE AFFORDED TO ALL INTERESTED PARTIES IN BEING HEARD CONCERNING:
A. None
VII. RESIDENT CORRESPONDENCE/PERSONS WISHING TO BE HEARD
A. Mr. Christopher Atkins, 693 Ulao Lane, voiced his opinion and concern regarding Ordinance 2010-09: Concrete Driveways.
B. Mr. Jeff Pitman, 142 Preserve Court, voiced his opinion and concern regarding Ordinance 2010-09: Concrete Driveways.
C. Mr. Kurt Hackbarth, 1733 Manchester Drive, voiced his opinion and concern regarding Ordinance 2010-09: Concrete Driveways.
D. Mr. Larry Zingsheim, 1845 Fairhaven, voiced his opinion and concern regarding Ordinance 2010-09: Concrete Driveways.
E. Mrs. Roberta Hackbarth, 1733 Manchester Drive, voiced her opinion and concern regarding Ordinance 2010-09: Concrete Driveways.
1. Mrs. Hackbarth stated that her and her husband entered into a contract with their Driveway Contractor before the Ordinance was passed in December of 2010. She also stated that the Contractor contacted the Town to ask of any pertinent permits or rules regarding the installation of their driveway.
2. Chairman Bartel stated that because Mr. & Mrs. Hackbarth entered into the contract with their Driveway Contractor before the Ordinance was passed, that the Board may be able to review their particular situation.
F. Mr. Jim Gresham, 112 Whitewater Court, Waterstone Subdivision, stated his concern regarding a possible special assessment for the Waterstone Subdivision residents.
G. Mr. Sheldon Rau, 789 Wild Duck Court, voiced his opinion and concern regarding Ordinance 2010-09: Concrete Driveways.
H. Mr. Matt Neumann, Neumann Builders, stated his concern regarding a possible special assessment for the Waterstone Subdivision residents.
I. Mr. Wally Bartel, 1144 Waterstone Court, stated his concern regarding a possible special assessment for the Waterstone Subdivision residents.
VIII. OLD BUSINESS
A. Reimbursement for costs incurred for easement for Test Wells on Sieracki property.
1. The Sieracki’s granted the Town of Grafton an easement to access the Denow Landfill area at no cost to the Town.
2. ACTION: Commissioner Sykora moved to pay the Sieracki’s legal fees pertaining to the Denow Landfill. Commissioner Grabow seconded the motion. Motion carries 4-0.
B. Discussion and possible action regarding letters sent to residents in violation of Town of Grafton Ordinance 2010-09: Concrete Driveways.
1. Supervisor Stockwell stated that the Homeowner’s concerns were understood and questioned legal staff about an agreement stating that the Homeowner would be fully responsible for any costs incurred from not conforming to the Ordinance.
2. Attorney MacCarthy stated that she did not think that an agreement between the Town and the Homeowner would be a feasible solution.
3. ACTION: Supervisor Stockwell moved to rescind and revisit the Town of Grafton Ordinance 2010-09: Concrete Driveways. Chairman Bartel seconded the motion. Motion fails 3-1.
4. ACTION: Supervisor Grabow moved to table the issue until the Board of Supervisors December 2011 meeting. Supervisor Sykora seconded the motion. Motion carries 4-0.
IX. NEW BUSINESS
A. Comparison, discussion and possible action regarding the proposals received from Veolia/Waste Management Inc. regarding Garbage/Recycling Services.
1. The representative from Veolia, Jason Johnson, stated that he would provide an updated proposal to the Town of Grafton for consideration.
2. ACTION: Supervisor Grabow moved to call a special meeting at 5:00pm on Wednesday, November 16th and table the item until the special meeting. Supervisor Sykora seconded the motion. Motion carries 4-0.
B. Discussion and possible action to determine if a variance could be granted to Mr. Kurt Hackbarth, Mr. Larry Zingsheim, Mr. Christopher Pitman and Mr. Chris Atkins regarding the Driveway Ordinance.
1. ACTION: Supervisor Sykora moved to make no action on this issue pending review of the Ordinance. Supervisor Stockwell seconded the motion. Motion carries 4-0.
C. Update on Fire Call Reimbursements
1. Attorney MacCarthy spoke with Chief Place who stated that the Town will soon be receiving the report requested.
D. Resolution No. 2011-9 – Preliminary Resolution Declaring Intent to Exercise Special Assessment Police Powers Under Wisconsin Statute Section 66.0703 For Completion of Improvements to Waterstone Subdivision, Including Reparations to Waterstone Drive, Whitewater Court, Waterstone Court, Wild Duck Court, and Wolf Creek Court.
1. ACTION: Supervisor Sykora moved to pass Resolution No. 2011-9 – Preliminary Resolution Declaring Intent to Exercise Special Assessment Police Powers under Wisconsin Statute Section 66.0703 for Completion of Improvements to Waterstone Subdivision, including Reparations to Waterstone Drive, Whitewater Court, Waterstone Court, Wild Duck Court and Wolf Creek Court. Supervisor Grabow seconded the motion. Motion carries 4-0.
E. Discussion and possible action regarding reduction of fees for the Chiselled Grape Winery Amendment to Conditional Use Permit.
1. ACTION: Chairman Bartel moved to deny the request regarding reduction of fees for the Chiselled Grape Winery Amendment to Conditional Use Permit. Supervisor Stockwell seconded the motion. Motion carries 4-0.
X. TOWN STAFF UPDATES
A. Engineering
1. All Road projects are done.
2. Falls Road Driveways have been paid.
3. Terminal Road is done also.
XI. APPOINTMENTS OF COMMITTEES
A. Board of Appeals for a 2-year term expiring June 30, 2013:
• Steve Wilkinson, Kim Viesselman, Craig Butler, Jonathan Stephens
1. ACTION: Supervisor Stockwell moved to extend their two year term based upon their acceptance. Supervisor Grabow seconded the motion. Motion carries. 4-0.
XII. REPORTS – FOR INFORMATION, DISCUSSION AND ACTION
A. Chair
1. A closed session needs to be held regarding the Denow Landfill costs at the December Board of Supervisors Meeting on December 14th, 2011.

XIV. ADJOURN
1. ACTION: Supervisor Grabow moved to adjourn subject to payment of bills. Supervisor Sykora seconded the motion. Motion carries 4-0.
