BOARD OF APPEALS MEETING
UNOFFICIAL MINUTES
I. CALL TO ORDER
A. Chairman Butler called the meeting and public hearing to order at 7:02 PM

II. CLERK’S ASSURANCE OF PROPER NOTICE
Town Clerk Wendy Weeks assured the meeting that the Agenda was properly noticed.
III. PLEDGE TO FLAG
IV. PUBLIC HEARINGS: A VARIANCE TO SECTION 10.1.3.07(F)(1) OF THE TOWN OF GRAFTON R-3
RESIDENTIAL DISTRICT ZONING ORDINANCE. A FRONT YARD SETBACK LESS THAN 50’FROM THE HIGHWAY
OR ROAD RIGHT-OF-WAY FOR 1908 FAIRHAVEN DRIVE, TAX KEY #05-057-0058.000, OWNED BY PATRICIA
MARCUS & RUTH SHORT.
A. Ms. Marcus apologized for not knowing the Town of Grafton regulations; their previous
municipality did not require permits for extra buildings. They did take out a permit after and
paid the double fee knowing it would be denied. They have investigated other locations on
the property for the shed but due to the property’s wetness and layout this is the only logical
location. She also provided pictures for everyone to view the property and shed location.
B. Ms. Short explained each picture and described how the shed blends in with the
surroundings. She also has 26 letters of support from the neighbors.
C. Inspector Fellenz explained there is about a 10 foot variance needed and understood the
placement of the shed because it fits nicely in the trees. He also explained other variances
have been granted in previous years on Woodhaven because of properties’ locations in
relations to the road right-of-ways.
D. Mr. Paul Olsen, 369 Woodhaven, said the shed blends nicely and fits the décor of the corner
lot.
E. Marty Moore, 376 Woodhaven, agrees the lot is very wet and said there is a natural spring in
the hill above the property. He also said the shed looks great.
F. Tom Roesch, 1830 Fairhaven, said the shed enhanced the property, the owners cleaned
out the corner to make it look better, and the shed looks wonderful.
G. Pete Jager, 1697 Fairhaven, agrees the owners have done a great job cleaning out the
brush and making the corner and road right-of-way more visible for drivers.
H. Chuck Milliken, 1724 Fairhaven, has driven by many times and feels safety has increased
because dead trees and brush have been removed.
I. Chairman Butler explained there are three steps to follow, the hard ship test, does not
require multiple variances, and there is no harm to the public.
J. ACTION - Chairman Butler closed the public hearing at 7:34 PM.
K. There was a little more discussion about whether the structure falls under the reasonable
use part of granting variances. According to the code, variances cannot be given for
accessory structures.

L. Building Inspector said the previous variance on Woodhaven for an extra garage was
granted after this code was approved. He also agrees that a shed is reasonable use due to
the amount of items needed to be stored outside such as snow blower, lawn mower, etc…
M. Hardship due to the unique property limitations applies to this property due to the wetlands
and spring. It also meets the requirement to have approval from the surrounding residents.
N. ACTION – Mr. Tom Sykora moved to approve the variance of the Marcus/Short shed,
seconded by Mr. Kim Viesselman. Motion carried unanimously.
V. ADJOURN
A. Motion to adjourn was made by Mr. Sykora, seconded by Mr. Wilkenson. Motion carried
unanimously.
