BOARD OF SUPERVISORS MEETING
November 10, 2010 Minutes
I. CALL TO ORDER
1. Chairman Bartel called the meeting to order at 7:00 P.M.
2. Present:

II. ASSURANCE OF PROPER NOTICE
1. Chairman Bartel assured the meeting was noticed properly
III. PLEDGE OF ALLEGIANCE TO THE FLAG
IV. ADOPTION OF AGENDA
1. ACTION: Supervisor Grabow moved to accept the agenda as presented, seconded by Supervisor Sykora. Motion carried 3-0
V. REVIEW & APPROVE MINUTES
1. ACTION: Supervisor moved to accept the minutes of the September meeting, seconded by Supervisor. Motion carried
VI. PUBLIC HEARINGS
A. None
VII. RESIDENT CORRESPONDENCE – PERSONS WISHING TO BE HEARD
A. Residents sent a letter of concern regarding the speed limit on Green Bay Rd.
1. Chairman Bartel has contacted the sheriff’s department to patrol the area.
2. Chairman Bartel explained that in the past the Town looked into installing traffic lights, however it wasn’t feasible.
3. The speed limit on the road could be looked at to see if it qualifies for a reduction.
4. Chairman Bartel explained that the residents will need to petition the Board for a speed limit reduction so this item can be placed on a future agenda. Mr. Bartel also requested that residents inform the Town if they do see the sheriff’s department patrolling the area just so it is confirmed.
5. Harold Nicolas of 589 Green Bay Rd stated that the problem out there is the lack of enforcement. The area is not patrolled enough; people are driving way too fast, when he gets his mail he has to run across the street because the people do not slow down.
6. David Gandt 678 Green Bay Rd stated that there is a major issue with children getting off of the school bus and vehicles aren’t slowing down. He has not seen the sheriff’s department out there since the last accident about a month ago. He has also offered to have the sheriff’s department sit in his driveway to radar but the sheriff’s department said they do not have the funding.
7. Maggie Uihlein 760 Green Bay Rd stated that there are hidden driveways and should have hidden driveway signs.
8. Donna Fix 724 Green Bay Rd a woman in a vehicle stopped to allow her to cross the street so she could get her mail and before she got across the road a truck smashed into the back of the stopped vehicle. She could have been killed when getting her mail; people are driving way too fast for the area. The brush needs to be trimmed.
9. Richard Polini 544 Highknoll Drive they use this road to avoid the stop signs and they are speeding.
10. Robert Skidmore 549 Green Bay Rd there is a green late model Camero that races down the road. Kids race down the road and it is curvy. Who would he contact to turn these speeders in? Supervisor Grabow stated he should contact the sheriff’s department with the license plate numbers.
11. David Bahrel 612 Green Bay Rd feels that the speed limit needs to be reduced and he feels there is too much truck traffic on this road.
12. Jack Prinz 646 Green Bay Rd the speeding is terrible and feels the speed limit should be 25 mph. It is difficult for homeowners to even get out of their driveways.
13. Robert Skidmore asked what the process is for changing the speed limit and changing the truck route. Chairman Bartel explained that this could appear on the December agenda for a public hearing. He will also call the sheriff’s department and request increased patrol.
14. Supervisor Grabow stated that the County will only trim brush in the Town’s right-of-way. Residents will have to supply the Town with a letter stating they give the Town permission to cut brush on their property if they if they want the sightline made larger.
15. Claude Wollner 1415 Falls Road asked for clarification on the assessment for the Falls Road project. Chairman Bartel explained that the assessment would have to be paid when the land owner annexes into the Village.
16. Mr. Wollner stated that the Town residents should have had input in this project because he doesn’t want curb and gutter.
17. Chairman Bartel explained that the Village did come to the Town and asked for financial assistance on this project but the Town is not in the position to take on this project at this time. This is not in the Town’s 5-year capital improvement plan.
VIII. OLD BUSINESS
A. 2010 Drainage Project Update
1. Green Valley Rd-already an existing drainage easement on the property, the DNR requested additional information that was submitted last week. The County stated that the Town will need a Shoreland Zoning Permit.
2. Falls Rd-is in review and will be ready for bidding in March.
3. Edgewater-Mr. Kriar would like to talk more with the Town
B. Resolution 2010-8-Acceptance of Road Dedication-Woodland Shores
1. Engineer Lundeen stated that the project is complete and she recommends approval.
2. ACTION: Supervisor Grabow moved to approve the resolution as presented, seconded by Supervisor Sykora. Motion carried 3-0
C. Letter of Credit Reduction-Woodland Shores
1. Engineer Lundeen recommends that the existing letter of credit be reduced by $70,500.00 and the Town keeps a letter of credit balance, for a period of one year, in the amount of $27,000.00 as a guarantee bond.
2. ACTION: Chairman Bartel moved to approve the letter of credit reduction as presented by staff, seconded by Supervisor Sykora. Motion carried 3-0
D. Update on procedures for action regarding concrete driveways installed in the Town’s Right-of-way
1. Engineer Lundeen explained that concrete will be allowed within 6 feet of the pavement edge
2. The final item will be placed on the December agenda for public hearing
3. No action taken
E. Update on Maintenance within the Town’s Right-of-way Ordinance
1. Attorney Hahn stated that the code states that every person is required by law to destroy all noxious weeds on lands in the Town which he owns, occupies or controls.
2. Supervisor Grabow asked what the notice is going to say that goes out in the spring.
3. Chairman Bartel would like to review the options and potential implications before the board makes any decisions.
4. No action taken
IX. NEW BUSINESS
A. Request for the Department of Administration (DOA) to submit payment of the lottery and gaming credit and 1st dollar credit directly to the Town instead of County
1. ACTION: Chairman Bartel moved to instruct the Clerk to issue a letter to the Department of Administration requesting direct payment, seconded by Supervisor Sykora. Motion carried 3-0
B. Emergency Septic Pumping Violation-Rick’s Pioneer Mobile
1. Attorney MacCarthy recommends the Board require a holding tank bond.
2. ACTION: Supervisor Grabow moved to instruct legal staff to contact the property owner and offer to enter into a deferred prosecution agreement or if the property owner is not amenable legal staff will move forward with prosecution, seconded by Supervisor Sykora. Motion carried 3-0
C. Pay request by Grade Tech Pavers for the Multi-Use Trail Project, Phase 1
1. ACTION: Supervisor Sykora moved to approve the pay request as recommended by staff, seconded by Supervisor Grabow. Motion carried 3-0
X. TOWN STAFF UPDATES
1. Engineer Lundeen stated that the VOG provided the Town with an estimate of costs for the Cedar Creek road project.
2. Engineer Lundeen gave a brief update on the Road Budget, the County went over the road budget so they will issue the Town a credit in addition to the road aids

XII. REPORTS – FOR INFORMATION, DISCUSSION AND ACTION
A. Chair
1. There are some openings on the Open Space Commission
2. The Town is looking at a 13 percent increase in the levy due to some of the Denow Landfill costs.

D. Presentation of Invoices
XIII. CONVENE INTO CLOSED SESSION – PURSUANT TO SECTION §19.85(1) (G), WIS. STATS, TO DISCUSS LEASE RENEWAL TERMS FOR TOWN HALL OFFICES AND MEETING ROOMS AND CONFER WITH THE TOWN’S LEGAL COUNSEL REGARDING LEGAL STRATEGY TO BE CONSIDERED BY THE TOWN BOARD REGARDING POTENTIAL LITIGATION CONCERNING BLUE SKY EDUCATIONAL FOUNDATION
1. ACTION: Supervisor Grabow moved to go into closed session, seconded by Supervisor Sykora. Motion carried 3-0
XIV. RETURN TO OPEN SESSION – PURSUANT TO WIS. STATS §19.85 (2) FOR ADDITIONAL DISCUSSION, AND EVALUATION
1. ACTION: Supervisor Grabow moved to return to open session, seconded by Supervisor Sykora. Motion carried 3-0
2. ACTION: Chairman Bartel moved to instruct legal staff to respond the letter received from Blue Sky instructing them of their options to agree with the assessment or amend their site plan, seconded by Supervisor Sykora. Motion carried 3-0
3. ACTION: Supervisor Sykora moved to approve the lease for the Town Hall for 4 years and subject to final legal staff review, seconded by Chairman Bartel. Motion carried 2-1 with Supervisor Grabow dissenting
XV. MISCELLANEOUS ITEMS DEEMED PERTINENT AS ALLOWED BY LAW
1. None
XVI. ADJOURN
1. Action – Motion made by Supervisor Sykora to adjourn, seconded by Supervisor Grabow. Motion carried 3-0
