BOARD OF SUPERVISORS MEETING
May 5, 2012 Minutes
I. CALL TO ORDER
1. Chairman Bartel called the meeting to order at 7:00 P.M.
2. Present:

II. ASSURANCE OF PROPER NOTICE
1. Town Clerk Erica Raffaele assured the meeting was noticed properly
III. PLEDGE OF ALLEGIANCE TO THE FLAG
IV. ADOPTION OF AGENDA
1. ACTION: Supervisor Grabow moved to amend the agenda as follows, “under New Business, move item I to be heard prior to item H”, seconded by Supervisor Sykora. Motion carried 5-0
2. ACTION: Supervisor Sykora moved to approve the agenda as amended, seconded by Supervisor Schaefer. Motion carried 5-0
V. REVIEW & APPROVE MINUTES
1. ACTION: Supervisor Sykora moved to approve the minutes of the previous meeting, seconded by Supervisor Stockwell. Motion carried 5-0
VI. PUBLIC HEARINGS
A. Ordinance 2012-03: Amending Title 2, Government and Administration, Ch. 2, Town Meeting, of the Town Code to conform with 2011 Wis Act 115, Changing Annual Meeting to 3rd Tuesday in April.
1. ACTION: Chairman Bartel opened the public hearing at 7:07 pm
2. No one wished to speak
3. ACTION: Chairman Bartel closed the public hearing at 7:08 pm
4. ACTION: Supervisor Stockwell moved to approve the ordinance as presented, seconded by Supervisor Sykora. Motion carried 5-0
VII. RESIDENT CORRESPONDENCE – PERSONS WISHING TO BE HEARD
A. A letter was read into the public record from JoAnn Otto, 585 Starboard Ct., in support of the multi-use trail project.
B. Kate Laskin, 422 Lake Bluff Ln, spoke in support of the multi-use trail project.
C. Mary McIntosh 1050 Lakeshore, spoke in opposition of the multi-use trail project.
D. Carl Baumann 153 Lakeshore Rd spoke in support of the multi-use trail project.
E. Greg Sommersburger, 893 Tallgrass Dr., spoke in support of the multi-use trail, however, he pointed out that it is a trail and he hopes the trail is constructed that it is not an eyesore.
VIII. OLD BUSINESS
A. None
IX. NEW BUSINESS
A. Resolution 2012-8: Adopting Employee Grievance Procedures, Workplace Safety Guidelines and Employee Handbook
1. ACTION: Supervisor Grabow moved to table this item, no one seconded. Motion fails
2. ACTION: Supervisor Stockwell moved to adopt the resolution, Supervisor Sykora seconded for discussion purposes. Motion fails 0-5
3. Supervisor Grabow and Supervisor Sykora would like to have more time to review the document.
4. Chairman Bartel directed staff to post the item as a special meeting following the May 12, 2012 Open Space meeting
B. Resolution 2012-9: Phase 3 Multi-Use Trail Grant Application
1. ACTION: Supervisor Sykora moved to approve the resolution, seconded by Supervisor Schaefer. Motion carried 5-0
C. Discussion on approving check in the amount of $2,800 to purchase an Easement for the Multi-Use Trail on the Bieck Management apartment property on Lakefield Road
1. Planner Schaefer stated that the Open Space Commission just had a discussion on this item and the Commission has not made an official motion to request this from the Board.
2. ACTION: Supervisor Sykora moved to refer this back to the Open Space Commission for further discussion and possible action, seconded by Supervisor Stockwell. Motion carried 5-0
D. Discussion of strategy for River Bend Road
1. Supervisors discussed the grant options and options for repairs that can be done.
2. Supervisor Stockwell asked if posts or reflectors could be placed for safety.
3. Engineer Clementi stated that staff will look at all the options to bring the road up to current standards whether that would be placing guard rails or possibly placing wider shoulders. This item is slated to be planned for this year and construction would carry out next year.
4. ACTION: No action taken, just discussion purposes
E. Veolia Solid Waste and Recycling Contract
1. Attorney MacCarthy stated that a $50,000 performance bond will be posted per the agreement
2. ACTION: Supervisor Sykora moved to approve the contract for 10 years pending final review of the Town’s legal Staff, seconded by Supervisor Grabow. Motion carried 5-0
F. Action regarding Ballard Posts to be installed at the entrances to the Multi-Use Trail
1. ACTION: Supervisor Sykora moved to approve installation of the posts with costs not to exceed $100, seconded by Supervisor Schaefer. Motion carries 5-0
G. Petition received to amend the Multi-Use Trail
1. Attorney MacCarthy stated that the CORP will be amended and hopefully be finalized by the end of this year
2. ACTION: Supervisor Sykora moved to deny the petition, seconded by Supervisor Schaefer. Motion carried 4-0, with Supervisor Grabow present but not voting

H. Discussion regarding Weapons Discharge Permit Application Changes
1. Attorney MacCarthy stated that residents have requested the Ordinance be modified to extend the length of the permit term from 120 days to a one year permit
2. ACTION: No action taken, This item will be placed on a future agenda for public hearing
I. Multi-Use Trail Map Amendments
1. ACTION: Supervisor Sykora moved to approve the amendment to the current map to reflect only the current phases (to remove any planning on the map shown through the Blank’s Crossing conservancy), seconded by Supervisor Stockwell. Motion carried 5-0
J. Economic Development Efforts by the Town and EDGE – Target List
1. Planner Schaefer presented a Targeted list of 5 areas in the Town that will be presented to EDGE to promote as detailed in the Supervisor’s packets
2. ACTION: No action taken
K. Discussion and possible award of 2012 Town Road Construction Project – Lakeshore Road Phase 4
1. ACTION: Supervisor Grabow moved to award the bid to Payne & Dolan with base bid plus alternate 1 and 2 for a total of $167,766.75, seconded by Supervisor Sykora. Motion carried 5-0
X. TOWN STAFF UPDATES
1. Code Enforcement
a. Resident at Estate of Bruce Yench property that they are in violation of the nuisance and sign code
2. Town Planner
a. Chiselled Grape Winery has confirmed that they are moving forward with their driveway plans and hope to have it finished by July 1st. Plans have not been submitted to Staff for review as of yet.
b. Welcome Mobil Mart still has not responded to Staff
3. Town Engineer
a. Drainage updates:
b. Edgewater Drainage Easement site meeting, field survey and wetland delineation have been completed. Next step is obtaining a construction cost proposal from Bob Hilgart
c. Beechwood Ln field survey and wetland delineation have been completed. Next step is the design of the new drainage system
d. River Bend Rd Culvert Correction: Staff has applied for State funding, all other work on hold pending funding
XI. APPOINTMENTS OF COMMITTEES
A. Reappointment of Open Space Committee Members
1. Chairperson Marjie Tomter, Commissioners Shawn Graff, Mike Uihlein, and Steve Wilkinson
2. ACTION: Supervisor Sykora moved to approve the appointments as recommended by Chairman Bartel, seconded by Supervisor Schaefer. Motion carried 4-0




XII. REPORTS – FOR INFORMATION, DISCUSSION AND ACTION
A. Chair
1. None
B. Supervisors
1. Supervisor Schaefer asked legal Staff if the terms of the Supervisors have to be changed now since the annual meeting date has been changed. Attorney MacCarthy stated that this will be appearing before the Board at a future meeting.
C. Clerk
1. Liquor license renewals did go out, inspections will take place at the end of the month
D. Presentation of Invoices
XIII. MISCELLANEOUS ITEMS DEEMED PERTINENT AS ALLOWED BY LAW
1. It has been discovered that there the Treasurer’s position was given a pay raise several years ago but the salary was never adjusted. The Town owes the Treasurer back pay of $2,160, this item has always been accounted for in the budget but not in the payroll.
XIV. CONVENE INTO CLOSED SESSION-PURSUANT TO SECTION 19.85(1)(G), WIS. STATS TO CONFER WITH THE TOWN’S LEGAL COUNSEL REGARDING STRATEGY TO BE CONSIDERED BY THE TOWN BOARD CONCERNING THE POTENTIAL LITIGATION REGARDING THE DENOW LANDFILL
1. ACTION: Supervisor Grabow moved to enter into closed session, seconded by Supervisor Schaefer. Motion carried 5-0
2. ROLL CALL:

3. ACTION: Supervisor Grabow moved to return to open session, seconded by Supervisor Schaefer. Motion carried 5-0
4. ACTION: Supervisor Schaefer moved to direct Town Legal Counsel to execute the tolling and standstill agreement, seconded by Supervisor Grabow. Motion carried 5-0
XV. CONVENE INTO CLOSED SESSION-PURSUANT TO SECTION 19.85(1)(G), WIS. STATS TO CONFER WITH THE TOWN’S LEGAL COUNSEL REGARDING STRATEGY TO BE CONSIDERED BY THE TOWN BOARD CONCERNING THE POTENTIAL LITIGATION REGARDING STEVEN, SHEILA AND TERRY SMITH, 1831 HWY W
1. ACTION: Supervisor Schaefer moved to enter into closed session, seconded by Supervisor Grabow. Motion carried 5-0

4. ACTION: Supervisor Sykora moved to authorize Town Legal Counsel to enter into a settlement agreement with Steven, Sheila and Terry Smith, seconded by Supervisor Schaefer. Motion carried 5-0

XVI. CONVENE INTO CLOSED SESSION-PURSUANT TO SECTION 19.85(1)(G), WIS. STATS TO CONFER WITH THE TOWN’S LEGAL COUNSEL REGARDING STRATEGY TO BE CONSIDERED BY THE TOWN BOARD CONCERNING THE POTENTIAL LITIGATION REGARDING DAVE AND SANDRA DAVIS, 437 LAKE BLUFF LANE
1. ACTION: Supervisor Schaefer moved to enter into closed session, seconded by Supervisor Grabow. Motion carried 5-0

1. Action – Motion made by Supervisor Schaefer to adjourn, seconded by Supervisor Sykora. Motion carried 5-0
