I. CALL TO ORDER

II. ASSURANCE OF PROPER NOTICE
A. Town Clerk Wendy Weeks assured that the Agenda was properly noticed.
III. ADOPTION OF AGENDA
A. ACTION: Commissioner Ansay moved to accept the Agenda as presented, seconded
by Commissioner Wolf. Motion carried unanimously.
IV. REVIEW AND APPROVE PREVIOUS MINUTES
A. ACTION: Commissioner Ansay moved to accept the April, 2006 Minutes, seconded
by Commissioner Wolf. Motion carried unanimously.
V. PUBLIC HEARINGS
A. A Minor Land Division and Rezoning Steven M. Schaefer and Cynthia B. Schaefer
(Schaefer Ponderosa), 1542 Lake Shore Rd., Tax Key #06-0166-030-05.00 to divide 38.02
acres into one (1) residential lot (Lot 1, 5.0 acres) and one remnant parcel (Lot 2, 31.2
acres) and rezone Lot 1 from A-1 to R-1 Residential and Lot 2 from A-1 to A-2
Agricultural/Rural Residential.
1. Chairman Bartel opened the Public Hearing at 7:05 pm. No one spoke for or against
the petition.
2. Public Hearing closed at 7:06 pm.
3. Town Engineer, Kristen Lundeen, informed property is a total of 38.02 acres with
existing zoning of A-1 with proposed zoning of R-1 and A-2. Applicant proposes to
divide off one (1) five (5) acre residential lot on the north side of this property and
rezone this property to R-1 residential and then by default the remnant parcel, Lot 2
would become A-2. Applicant submitted a list of minor technical punchlist items which
include having the ingress/egress easement revised to be a separate document
requiring signatures from the adjacent property owner indicating that they agree to
the movement of the ingress/egress easement. Staff also recommends that the
applicant include a statement on the deed indicating that the remnant parcel is a
working farm. Construction or reconstruction of the existing barn and farm facilities
may not be allowed in the narrow portion that extends to the lake due to Ag-2
setbacks requirements. Staff recommends approval.

4. ACTION: Commissioner Ansay moved to accept the land division as
presented, subject to completion of staff punchlist items and payment of all
fees, seconded by Commissioner Clapper. Motion carried unanimously.
5. ACTION: Commissioner Clapper moved to recommend re-zoning per the
application, seconded by Commissioner Ansay. Motion carried unanimously.

B. Cornerstone Church-Tom Bartlein - A Conditional Use Permit for Cornerstone Church to
build a church at Tax Key #06-029-06-004.00.
VI. OLD BUSINESS
A. Conditional Use Permit Review – Robert Tillmann – Discussion and possible action
concerning review/renew of Conditional Use Permit # 03-08 to Mine Sand & Gravel at Tax
Key #06-004-05-002.00, CTY HWY 32.
1. Town Engineer Kristen Lundeen advised this is a carry over from the December,
2005 Plan Commission meeting. This Conditional Use Permit renewal was
contingent upon the approval from the Ozaukee County Planning, Resources & Land
Management which has been granted – The WI DNR has also been granted – The
U.S. Army Corps of Engineers this is currently pending as this has been placed a
“Cease All Reviews” due Hurricane Katrina relief efforts. Staff recommends that the
Plan Commission table the CUP approval until the Army Corps of Engineers finishes
and approves everything. This will be brought up again in December, 2006.
2. ACTION: Commissioner Clapper moved to table until the December 2006,
seconded by Commissioner Hefle. Motion carries 6 – 0 with Commissioner
Ansay abstaining due to a professional conflict.
B. River Forest LLC - Final Language regarding Section 10.1.3.12 of the Town of Grafton
Zoning Code. - Revising the Residential Conservation Development Overlay Zoning
District
1. Town Planner Jamie Rybarczyk discussed the revisions from the meeting that was
held in April. Everything remained the same except;
a. page (5), referring to density and dimensional standards, it now reads single
family units, before it was single family lots.
b. page (6), regarding maximum density for two family residential lots, increased
the percentage from 10% to 15%, so the remaining part of the language still
remains as it was presented earlier. That is, 15% for the duplexes, a
maximum as allowed per review and recommendation of Plan and Staff.
c. Cash Contributions on page (12), item (1), this pertains how the Town Board
may go about formulating how much money the Town could get in place of
open space.
d. Commissioner Clapper suggested that on page (6), the word shall be
replaced with the words may be placed. It also should say at the discretion of
the Town Board, Town Plan Commission or Town Staff.
e. On page (17), Commissioner Hefle questioned Sanitary Facilities. Town
Planner Rybarczyk responded that with potential density there could be
concerns about failing systems. Town Engineer Kimmes stated the concept
stage should address system failure and what could potentially happen.
County would be the authority to intervene, not the Town. This would refer to
development clusters of (2) or more units must have an area planned for a
secondary (backup) system that is acceptable by the Town of Grafton or
governing body in the event of a facility failure.

2. ACTION: Commissioner Clapper moved that this amended RCDO document
go to the Town Board for adoption at a Public Hearing, seconded by
Commissioner Wolf. Motion carried unanimously.
3. Town Engineer Lundeen said as of yet, they haven’t received a commitment from
River Forest LLC for the signing of the creation of a PUD. Town Engineers will get
back to River Forest LLC with the final product of the proceedings.

VII. RESIDENT CORRESPONDENCE/PERSONS WISHING TO BE HEARD.
Discussion and possible action concerning any resident correspondence received.
A. None
VIII. TOWN STAFF UPDATES
A. Conditional Use Permit Application – Discussion concerning a new format and updated fees
for the Town of Grafton’s conditional use permit procedure.
B. Berm Permit Application – Discussion concerning a new format and updated fees for the
Town of Grafton’s berm permit procedure.
1. (A&B) Town Engineer Kristen Lundeen spoke to both the Conditional Use Permit
and Berm Permit regarding their reformat and update. Questions were raised by
Commissioners regarding the up front escrow fees; hourly charges for Professional
Service Staff which was explained by Town Engineer Lundeen. Accountability of
time will be estimated and presented to applicant. Commissioner Sperber thought a
separate escrow fee schedule would be acceptable for the private homeowner,
business and commercial development. Town Engineer Lundeen agreed this could
be done. The changes will be made and brought before the Board, as fees require
Board approval.
C. Building Inspector- Discussion and possible action concerning an additional accessory
structure over 150 square feet but less than 800 square feet at 1496 Woodland Drive,
Dennis & Gina Eichorn, owners.
1. Building Inspector Rick Fellenz visited the Ordinance that allows (1) accessory
structure over 150 sq feet unless they need a second one. It doesn’t say you are
allowed only (1) shed, you could have this as long as you meet the setbacks with a
150 sq foot building. Building Inspector Fellenz recommended approval at this time.
This will be brought up at next month’s meeting regarding this loophole in the
Ordinance.
ACTION: Commissioner Clapper moved to accept the application for an
additional accessory building to be built at 1496 Woodland Drive, seconded by
Commissioner Hefle. Motion carried unanimously.
IX. MISCELLANEOUS ITEMS DEEMED PERTINENT AS ALLOWED BY LAW.
A. Commissioner Ansay spoke to his conversation with Mr. Sal Palmisano regarding the
development on the Leben property on Pioneer Rd. Mequon has as a part of their rezoning
that a portion of this land is R-3 and a portion is still A-1. He has the right to come in on the
parcel that is zoned R-3 and present an R-3 zoning which is not Conservation. The area
that is A-1 would have to be a reconvene JETZCO matter. Property owner has the right to
rezone the portion that is R-3 without involving Mequon and we can act on that. The R-3
goes to the quarter section line, this is along Port Rd. There is no conservancy on any of
that zoning
B. Commissioner Hefle asked for volunteers to man the booth on Saturday, May 6, 2006
regarding the Ozaukee County Comprehensive Plan Open House/ Design Workshop at the
Grafton Elementary School Gym.

X. ADJOURN
A. Action –Commissioner Ansay moved to adjourn meeting. Seconded by all
Commissioners. Motion carried 6-0.
