BOARD OF SUPERVISORS MEETING

I. CALL TO ORDER

II. ASSURANCE OF PROPER NOTICE
1. Action- Clerk Schmidt assured that the meeting was properly noticed
III. PLEDGE OF ALLEGIANCE TO THE FLAG
IV. REVIEW AND ADOPT AGENDA
1. Action-Supervisor Grabow moved to adopt the agenda, seconded by Supervisor Helms. Motion carried 5-0
V. NEW BUSINESS
1. Bid Award for the Lakeshore Road project
2. Engineer Lundeen stated that there were two bidders for the project, Stark Asphalt and Payne & Dolan.
3. Stark Asphalt was the lowest bidder.
4. Action-Supervisor Rogers moved to award the Lakeshore Road Trip allocated bid to Stark Asphalt for Alternate two for $217,652.50, seconded by Supervisor Sykora. Motion carried 5-0
VI. MISCELLANEOUS ITEMS DEEMED PERTINENT AS ALLOWED BY LAW
1. No one wished to address the Board.
VII. CONVENE INTO CLOSED SESSION – PURSUANT TO SECTION §19.85(1) (G), WIS. STATS, TO CONFER WITH THE TOWN’S LEGAL COUNSEL REGARDING LEGAL STRATEGY TO BE CONSIDERED BY THE TOWN BOARD REGARDING POTENTIAL LITIGATION CONCERNING DELINQUENT ACCOUNTS RECEIVABLE.
1. ACTION - Motion made by Supervisor Grabow to adjourn into closed session, seconded by Supervisor Helms. Motion carried 5-0:

VIII. RETURN TO OPEN SESSION – PURSUANT TO WIS. STATS. §19.85 (2) FOR ADDITIONAL DISCUSSION, EVALUATION, AND PREPARATION OF LEGAL ACTION REGARDING DELINQUENT ACCOUNTS RECEIVABLE

1. Action-Supervisor Helms moved to return to open session, seconded by Supervisor Sykora. Motion carried 5-0
2. Action-Supervisor Helms moved to authorize Legal staff to initiate collection action on delinquent account Sal Palmisano and his corporate entity, seconded by Supervisor Rogers. Motion carried 5-0
3. Action- Supervisor Helms moved to authorize Legal Staff to proceed with a collection letter to Heartland Development for delinquent accounts receivable, seconded by Supervisor Sykora. Motion carried 5-0.
IX. ADJOURN
1. Action-Supervisor Sykora moved to adjourn, seconded by Supervisor Grabow. Motion carried 5-0.
