BOARD OF SUPERVISORS MEETING

I. CALL TO ORDER
A. Chairman Bartel called the meeting to order at 7:02 PM.

II. ASSURANCE OF PROPER NOTICE
A. Chairman Bartel assured the meeting was noticed properly in the absence of Town Clerk Raffaele.
III. PLEDGE OF ALLEGIANCE TO THE FLAG
IV. REVIEW AND ADOPT AGENDA
A. ACTION: Supervisor Sykora moved to approve the agenda as presented. Supervisor Schaefer seconded the motion. Motion carried 5-0.
V. APPROVE MINUTES FROM PREVIOUS MEETING
A. ACTION: Supervisor Grabow moved to approve the minutes as amended. Supervisor Sykora seconded the motion. Motion carried 4-0 with Supervisor Schaefer abstaining.
VI. PUBLIC HEARINGS - OPPORTUNITY WILL BE AFFORDED TO ALL INTERESTED PARTIES IN BEING HEARD CONCERNING:
VII. RESIDENT CORRESPONDENCE/PERSONS WISHING TO BE HEARD
A. Let the public record show that no residents wished to address the Board of Supervisors.
VIII. OLD BUSINESS
A. Nuisance Property – Estate of Eileen Nimtz, 368 Riverview Drive, Tax Key #06-051-04-11.00 (Tabled Issue)
1. Chairman Bartel stated that he went past the property and that things look well kept. There are vehicles there, but they are in the process of getting rid of those vehicles.
2. ACTION: Supervisor Sykora moved to take the issue off the table. Supervisor Stockwell seconded the motion. Motion carried 5-0.
3. Chairman Bartel referenced the correspondence from Attorney John Gallo updating the Town on the state of the property and what is being done.
4. Supervisor Grabow stated that the Town has to remember to check out the weed condition in the Spring of this year.
5. ACTION: Supervisor Grabow moved to table this issue until the April 11, 2012 Board meeting. Supervisor Schaefer seconded the motion. Motion carried 5-0.
B. Fire Department and Ambulance Services Contract Renewal.
1. ACTION: Supervisor Sykora moved to approve the Fire Department and Ambulance Services Contract. Supervisor Stockwell seconded the motion. Motion carried 5-0.
IX. NEW BUSINESS
A. Town of Grafton Resolution 2012-5: Adopting 2012 Fee Schedule.
1. ACTION: Supervisor Sykora moved to adopt the Town of Grafton 2012 Fee Schedule. Supervisor Stockwell seconded the motion. Motion carried 5-0.
B. Town of Grafton Resolution 2012-6: Reducing Speed Limit on County Hwy Q to Freeway from 55 mph to 45 mph.
1. ACTION: Supervisor Sykora moved to approve Town of Grafton Resolution 2012-6: Reducing Speed Limit on County Hwy Q to Freeway from 55 mph to 45 mph. Supervisor Schaefer seconded the motion. Motion carried 5-0.
C. Map Correction for a parcel just north of the Nevels site – should be A-2 but it is shown as A-1.
D. Town-initiated re-zone for the clubhouse portion of Fire Ridge Golf Course from A-1 to B-1.
1. Town Planner Schaefer stated that the Fire Ridge Owner plans to construct an accessory structure for outdoor storage for electric golf carts. During the pre-application meeting an error was discovered on the zoning map. The area by the Fire Ridge Golf Course Clubhouse should be zoned B-1.
X. TOWN STAFF UPDATES
A. Town Planner
1. Outstanding Development Applications Update
a. Chiselled Grape Winery – They received conditional approval on Nov. 2nd, 2011 for an Amendment to the Conditional Use Permit. To date there has still been no submittal of any materials. The Chiselled Grape Winery has submitted payment to the Town of Grafton in the amount of $600.00.
i. Town Planner Schaefer stated that because of Sunset Clauses, when conditional approval was granted on November 2nd, that then starts the clock and gives them 18 months to implement any of the punch list items that were conditions of the approval of their application.
ii. Supervisor Stockwell stated that with the Sunset Clauses, that gives the Chiselled Grape Winery until May 2, 2013.
iii. Town Planner Schaefer stated that everything has to be completed and submitted by May 2nd, 2013.
iv. Chairman Bartel stated that even if punch list items were submitted, the Town’s professional staff would not review any of the items due to the outstanding balance that the Chiselled Grape owes to the Town of Grafton. They would have to pay their current outstanding balance and deposit more money into their escrow account in order for anything further to be reviewed.
v. Town Planner Schaefer will update the Staff Report on the Chiselled Grape Winery to include any and all changes/corrections/waivers that have been stated in order to grant the Conditional Use Permit Amendment.
b. Welcome Mobil Mart – Received Conditional Approval on December 7, 2011. To date there have been no submittals of any punch list items.
i. Attorney MacCarthy stated that Mr. Walia is now the owner of the property located at 112 N. Port Washington Road.
B. Town Attorney
1. Outstanding Issues
a. Arnold Albrecht:
i. Supervisor Grabow questioned the status of the nuisance violation, and Chairman Bartel stated that this case has settled.
ii. Supervisor Stockwell questioned how long Mr. Albrecht has to complete his obligation under the Settlement Agreement.
iii. Attorney MacCarthy stated that the Town has not dismissed the action, it is still pending in the Ozaukee County Circuit Court. She also stated that Mr. Albrecht has until July 17th.
C. Town Engineer

XII. REPORTS – FOR INFORMATION, DISCUSSION AND ACTION
A. Chair
1. Chairman Bartel stated that the 2012 Road Tour will be in August.
B. Supervisors
1. Supervisor Grabow stated that it was 2009 when the last inspection was done for restaurants and facilities that have liquor licenses. Last time the entities that did the inspection were as follows: Rick Fellenz, Fire Department, Firearms Tobacco and Alcohol, and Public Health Department.
2. Supervisor Schaefer questioned what was happening with the Veolia Contract.
a. Attorney MacCarthy stated that a meeting was held with Jason Johnson of Veolia the day before the Board Meeting. She also stated that the terms are still being negotiated.
b. Chairman Bartel stated that we will hopefully have the Contract in front of us for the April 11th Board meeting to review and approve.
c. Attorney MacCarthy stated that the target for delivery of the new 96 gallon bins is May 1, 2012.
3. Supervisor Grabow questioned if the Fire Department decides to go to a paid fire chief, when the Town of Grafton will be notified for budgeting purposes.
a. Chairman Bartel stated that the meeting to discuss the current contract went very well. The Fire Chief and Chairman Bartel will be meeting again soon, but Chairman Bartel does not feel that there will be a “paid” fire chief to run a “volunteer” fire department.
4. Supervisor Stockwell asked when the Annual Meeting will be.
a. Chairman Bartel stated that the Annual Meeting falls on the second Tuesday in April, which would be April 10th.
5. Supervisor Grabow questioned Engineer Clementi on the final road costs for 2011. Also, what projects were done from last year, and which projects still need to be completed?
a. Engineer Clementi stated that he will be bringing a full report to the Board of Supervisors meeting in April.
6. Supervisor Grabow questioned if Engineer Clementi had started to look at any Drainage Projects for 2012? Supervisor Grabow stated that the two that should be looked at would be Edgewater & Beechwood. River Bend Road should be done in 2013.
a. Engineer Clementi stated that he will be bringing a full report to the Board of Supervisors meeting in April.
7. Supervisor Grabow stated that a donation was made for the Little League Ball Park from the Town of Grafton. The Ball Park is no longer being built.
a. Chairman Bartel stated that he will contact Mark Koehler regarding the donation.

A. ACTION: Supervisor Grabow moved to adjourn subject to payment of bills. Supervisor Sykora seconded the motion. Motion carried 5-0.
