BOARD OF SUPERVISORS MEETING

I. CALL TO ORDER
A. Chairman Bartel called the meeting to order at 7:02 PM.

II. ASSURANCE OF PROPER NOTICE
A. Town Clerk Erica Raffaele assured the meeting was noticed properly.
III. PLEDGE OF ALLEGIANCE TO THE FLAG
IV. REVIEW AND ADOPT AGENDA
A. ACTION: Supervisor Grabow moved to approve the agenda as presented. Supervisor Sykora seconded the motion. Motion carries 4-0.
V. APPROVE MINUTES FROM PREVIOUS MEETING
A. ACTION: Supervisor Grabow moved to approve the minutes as presented. Supervisor Sykora seconded the motion. Motion carries 3-0 with Supervisor Schaefer abstaining.
VI. PUBLIC HEARINGS - OPPORTUNITY WILL BE AFFORDED TO ALL INTERESTED PARTIES IN BEING HEARD CONCERNING:
A. Town of Grafton Ordinance 2012-02: Driveway Ordinance
1. Chairman Bartel opened the public hearing at 7:04pm.
2. No one wished to speak.
3. Chairman Bartel closed the public hearing at 7:05pm.
4. Engineer Clementi stated that one of the new requirements of the Ordinance is that the driveway must slope away from the road.
5. Supervisor Grabow questioned how are we going to enforce the Concrete?
6. Engineer Clementi stated that when a new home is built or a driveway is going in, a permit should be pulled and the Building Inspector will go out to inspect the driveway.
7. Supervisor Sykora questioned what happens if someone puts in a driveway without pulling a permit, will the Town go in and rip out the driveway?
8. Chairman Bartel stated that one of the issues discussed was that, and after discussions everyone had agreed that if a resident put in a driveway without pulling the proper permits and there were issues, it would be at the resident’s cost to rip out the driveway.
9. Engineer Clementi stated that from the Board’s recommendation, number 7 of the Ordinance would change to “If constructed with concrete, when completed, the driveway shall slope away from the roadway at no less than 2% which is a quarter inch per foot, until .6 feet from the edge of the pavement”.
10. Chairman Bartel stated that if you are putting in a new driveway, if it’s anything other than aggregate or asphalt, you will need to pull a driveway permit. If you’re having a culvert put in, you going to get a culvert permit.
11. ACTION: Supervisor Grabow moved to approve Town Ordinance 2012-02 as amended. Supervisor Sykora seconded the motion. Motion carried 4-0.
VII. RESIDENT CORRESPONDENCE/PERSONS WISHING TO BE HEARD
A. Harold Tomesch, Chiselled Grape Winery, spoke regarding relief of fees related to the amendment for the Chiselled Grape Winery. He asked the Town to share the costs by half.
1. Mr. Tomesch believes there was something lost in the switching of engineers.
2. Mr. Tomesch stated that he has a problem paying the amount that at his estimation led nowhere.
3. Chairman Bartel stated that the last time the Chiselled Grape Winery addressed the Board, there was a very detailed search done regarding time billed to the Chiselled Grape Winery, and the Board is very confident that all of the charges were billed properly.

A. Town of Grafton Resolution 2012-1: Accepting Waterstone Subdivision
1. Engineer Clementi did a review of the pavement and found that the roads look good and that the Contractor has been paid. He believes it is appropriate for the Town to accept the Waterstone Subdivision roads at this time.
2. ACTION: Supervisor Sykora moved to accept Resolution 2012-1. Supervisor Schaefer seconded the motion. Motion carried 4-0.
B. Town of Grafton Resolution 2012-2: Resolution Designating Public Depository for Miscellaneous Public Accounts and Authorizing Withdrawal of Public Moneys.
1. ACTION: Supervisor Sykora moved to approve Resolution 2012-2. Supervisor Schaefer seconded the motion. Motion carried 4-0.
C. Town of Grafton Resolution 2012-3: Amending the Town of Grafton’s Fee Schedule for 2 different fees: Background Checks on Liquor/Operator’s Licenses, and address marker fees.
1. ACTION: Chairman Bartel moved to approve Resolution 2012-3. Supervisor Sykora seconded the motion. Motion carried 4-0.
D. Town of Grafton Resolution 2012-4: Resolution Authorizing the Borrowing of Funds to Cover Municipal Expenses
1. ACTION: Supervisor Sykora moved to approve Resolution 2012-4. Supervisor Schaefer seconded the motion. Motion carried 4-0.
E. Application for Operator’s License for Glenda Nagel, 1268 Trail Way Court, Grafton, WI 53024 (Chiselled Grape Winery – 1206 Lakefield Road, Grafton, WI)
1. ACTION: Supervisor Grabow moved to approve the Application for an Operator’s License for Glenda Nagel. Supervisor Schaefer seconded the motion. Motion carried 4-0.
F. Rescinded Taxes for Robert Habich, 2276 Maple Road, Grafton, WI.
1. Chairman Bartel stated that Mr. Habich purchased this property after the residence burned down. The razing permit was pulled in July of last year, but the improvements should have been taken off the tax bill at the end of 2010. The property on this years (2011) tax bill still reflected a residence.
2. ACTION: Supervisor Sykora moved to approve rescinding the property taxes for 2276 Maple Road. Supervisor Grabow seconded the motion. Motion carried 4-0.

1. Code Enforcement
a. Family Farm - 308 Port Washington Road – Signage
i. Planner Schaefer stated that the reason that Inspector Gresky went to the property is because there was concern that there was excessive signage without proper permits.
ii. Chairman Bartel stated that the billboards on the Family Farm property would be considered pre-existing non-conforming.
iii. Chairman Bartel stated that he did not believe that the Town has accepted the road yet because there are only two developments on it, so technically the road is considered a “private drive”.
iv. Inspector Gresky recommended further investigation would be needed. Permits should be checked and signs should be inspected to make sure they are within the Town’s Code of Ordinances.
v. Plan Commission recommended Mr. Musich be contacted regarding the sign facing the freeway, ask Mr. Musich to get a temporary sign permit for that sign.
b. 1102 Lakefield Road – Signing
i. Inspector Gresky stated that there was a report of a political sign attached to an existing sign.
ii. After inspection, Inspector Gresky stated that the political sign was no longer posted on the existing sign.
iii. Inspector Gresky recommended no further investigation was needed due to the political sign being removed prior to investigation.
iv. Plan Commission recommended that Clerk Raffaele send a letter to the property owner recommending that the existing sign be removed.

1. Outstanding Development Applications Update
a. Chiselled Grape Winery – Amendment to Conditional Use Permit
i. Planner Schaefer stated that the Chiselled Grape Winery received Conditional Approval on Nov. 2, 2011 for their Conditional Use Permit Amendment Application.
ii. Planner Schaefer stated that to date, none of the punch list items have been addressed.
b. Welcome Mobil Mart – Conditional Use Permit
i. Planner Schaefer stated that the Welcome Mobil Mart received Conditional Approval on Dec. 7, 2011.
ii. Planner Schaefer stated that to date, none of the punch list items have been addressed.
D. Town Engineer
1. Outstanding Development Applications Update
a. Holton Brothers – Site Plan Application
i. Engineer Clementi stated that Stantec is out at the site weekly doing Erosion Control Inspections.
ii. Engineer Clementi stated that there is an issue with tracking mud onto the road.

1. Supervisor Schaefer questioned the speed limit change on Ulao. Would it be possible to make the entire stretch 45mph.
2. Chairman Bartel recommended that the Town draft a resolution for March’s meeting encouraging the County to reduce the Speed Limit.
3. Supervisor Grabow stated that he would fix the “No Discharge” Signs.

XIII. MISCELLANEOUS ITEMS DEEMED PERTINENT AS ALLOWED BY LAW
XIV. CONVENE INTO CLOSED SESSION – PURSUANT TO SECTION § 19.85(1)(G), WIS. STATS., TO CONFER WITH THE TOWN’S LEGAL COUNSEL REGARDING STRATEGY TO BE CONSIDERED BY THE TOWN BOARD REGARDING POTENTIAL LITIGATION CONCERNING THE DENOW LANDFILL.
A. ACTION: Supervisor Sykora moved to convene into Closed Session. Supervisor Schaefer seconded the motion. Motion carried 4-0.
XV. ADJOURN
A. ACTION: Supervisor Grabow moved to adjourn subject to payment of bills. Supervisor Sykora seconded the motion. Motion carries 4-0.
