BOARD OF SUPERVISORS MEETING
February 20, 2008
Official Minutes
I. CALL TO ORDER
A. Chairman Bartel called the meeting to order at 7:00 P.M.

II. PLEDGE OF ALLEGIANCE TO THE FLAG
III. ASSURANCE OF PROPER NOTICE
Town Clerk Jessica Schmidt assured the meeting that the Agenda was properly noticed.
IV. ADOPTION OF AGENDA
A. ACTION: Supervisor Helms moved to accept Agenda, seconded by Supervisor Kaul.
Motion carried 4-0.
V. REVIEW & APPROVE MINUTES
A. Minutes from the January 2008 meeting will be presented March 12, 2008.
VI. RESIDENT CORRESPONDENCE/PERSONS WISHING TO BE HEARD
A. Tall Grass , written correspondence.
B. John Cummings, called Supervisor Kaul, Mequon Police Department has been sitting at the
Mequon Road Exit of I-43 on Pioneer Road to issue citations to vehicle traveling south on I-
43 that are in the Town of Grafton. Town staff will follow up on protocol.
C. Residents contacted Supervisor Helms private snow plows are leaving ridges of snow
across the road.
1. It is legal for snow to be pushed across the road.
VII. OLD BUSINESS
A. Update on weapons discharge informational handout
1. Draft version will be available at the March meeting.
B. Adoption of Title 1-General Provisions, Chapters 1 and 2; Title 2-Government and
Administration, Chapters 1-10; Title 3-Public Safety, Chapters 1-3; Title 7-Licensing and
Regulation, Chapters 1-6 and 15; Title 9-Public Nuisances, Chapter 3; and Title 10-Land
Use, Chapters 3 and 9
1. Engineer Lundeen reported the Zoning and Land Division Code are available for
review. Legal will have the remaining section in the coming months.
2. Staff punchlist for codification was presented for review.
VIII. NEW BUSINESS
A. Resolution 2008-01 Great Lakes Compact Resolution
1. Ozaukee County’s resolution was presented to the Supervisors.
2. Resolution will be altered to include the Town of Grafton information in replace of
Ozaukee County’s information.

3. ACTION – Supervisor Rogers moved to adopt Resolution 2008-01 properly
formatted for the Town of Grafton, seconded by Supervisor Kaul. Motion
carried 5-0.
B. Set the Road Tour Date
1. Engineer Lundeen reported on the current road budget and suggested moving the
road tour to May or June based on a recommendation from the Wisconsin Towns
Association.
2. Date will be set in June 2008.
3. No Action Taken.
C. Public Hearing Fee increase
1. See Item E – Duplicate.
D. Kay Tutewohl Appointment of Election Inspector (poll worker) for a 2 year term
1. Moved to Appointments Item X.
E. Public Hearing Fee increase to $250 from $200 –To cover increased staff time by the
Town to gather and notify residents within 500 feet of developments
1. Plan Commission recommends approval of the fee increase.
2. ACTION – Supervisor Kaul moved to approve the public hearing fee increase
to $250.00, seconded by Supervisor Grabow. Motion carried 5-0.
F. 2008 Annual map updates
1. Engineer Lundeen updates have been complete. Draft versions were presented.
Final maps approval will be discussed at the March 12, 2008 meeting.
2. No Action Taken.
G. $250 Map update fee
1. Engineer Lundeen discussed the implementation of a map update fee with
applications involving land changes, in example rezoning, land use plan map
amendments, or land division.
2. Maps will then be reprinted after each application. There will still be an annual map
update to include other items such as land combinations.
3. ACTION – Supervisor Grabow moved to approve a $250.00 fee to update Town
maps for Rezoning, Land Use Plan Map Amendments, and Land Divisions;
map updates will be completed quarterly, seconded by Supervisor Rogers.
Motion carried 5-0.
H. Urban Planning Grant-Evidence of Community’s local share of the grant project costs,
possible budget amendment
1. Engineer Lundeen explained the DNR has requested a meeting to review the scope
of the grant. In order to accept the awarded grant the Town needs to provide proof of
the Town’s share of the grant in the amount of $19,100.
2. The work on the grant will not begin until 2009.
3. ACTION – Chairman Bartel moved to approve $19,100.00 for the Urban
Planning Grant for the 2009 budget year, seconded by Supervisor Helms.
Motion carried 5-0.
IX. TOWN ENGINEER UPDATE
A. Supervisor Grabow asked Engineer Lundeen for:
1. Update on nuisance violating properties.
2. Update on cooperative storm water management plans with the Village of Grafton.
Item should be addressed at AdHoc.
3. Update on increasing front yard set backs to 75 feet for arterial roads.

4. Are razing permits required? Yes, it needs to be clarified in the building permit fee
schedule and zoning code.
5. What is the procedure for parties failing to obtain a conditional use permit or an
erosion control permit and then moving forward with their project? Attorney
MacCarthy explained the Town would have to file an action to cease all activity.
6. Mr. Tillman’s STH 32 mining operation is in question. Town Staff will check into the
site.
X. APPOINTMENTS OF COMMITTEES
A. EDGE – Lester Bartel
1. ACTION – Supervisor Rogers moved to recommend appointment of Lester
Bartel to EDGE; seconded by Supervisor Helms. Motion carried 4-0, Chairman
Bartel abstaining.
B. Kay Tutewohl Appointment of Election Inspector (poll worker) for a 2 year term
1. ACTION – Supervisor Grabow moved to appoint Kay Tutewohl to a two year
term as an election inspector; seconded by Supervisor Kaul. Motion carried 5-
0.
XI. REPORTS – FOR INFORMATION, DISCUSSION AND ACTION
A. Chair
1. Update on Country Side Campers
a. Chairman Bartel contacted the owner of the property. A copy of the follow-up
letter was distributed to the Supervisors.
2. Review of walking quorum-all correspondence should be carbon copied to Clerk and
Chairman
a. Information sent via e-mail is okay but discussion about business is not
permitted between Supervisors. Same rules apply for face-to-face contact or
phone conversations. Make sure to always copy the clerk on e-mails
3. Chairman Bartel attended Grafton Area Tourism Council meeting and gave a brief
overview.
4. 1520 Green Bay Rd is being cleaned up by the property owner.
B. Supervisors
1. Supervisor Kaul, Falls Road east of HWY C, the trees at 834 Falls Road maybe
encroaching in the road right-of-way. He will contact the owner.
2. Supervisor Grabow reported the state does not cap the amount of liability a
municipality has when trees in the right-of-way cause an accident.
a. The Town’s liability coverage is $2 million.
3. Supervisor Kaul reminded the meeting of the Land Conservation Partnership land
purchase of development right forums on March 6 and 7, 2008
C. Clerk
1. Update on Fire Call Billing
a. The Town is waiting for a cost break-down from the Fire Department.
2. Update on Cable station
a. The electronic part to fix the cable station is no longer available.
3. Nuisance letters sent
D. Open Space Committee
1. None

XII. MISCELLANEOUS ITEMS DEEMED PERTINENT AS ALLOWED BY LAW.
A. None
XIII. CONVENE INTO CLOSED SESSION – PURSUANT TO SECTION §19.85(1) (G), WIS. STATS, TO CONFER
WITH THE TOWN’S LEGAL COUNSEL REGARDING LEGAL STRATEGY TO BE CONSIDERED BY THE TOWN BOARD
REGARDING POTENTIAL LITIGATION CONCERNING THE CITY OF MEQUON LAWSUIT.
A. ACTION - Motion was made by Supervisor Grabow to adjourn into closed session;
seconded by Supervisor Helms. Motion carried:

XIV. RETURN TO OPEN SESSION – PURSUANT TO WIS. STATS. §19.85 (2) FOR ADDITIONAL DISCUSSION,
EVALUATION, AND PREPARATION OF LEGAL ACTION REGARDING THE CITY OF MEQUON LAWSUIT.
A. ACTION – Supervisor Helms moved to instruct the Town Attorney to answer the court
and City of Mequon Attorney as per the details of the closed session discussion;
seconded by Supervisor Kaul. Motion carried 5-0.
XV. ADJOURN
A. Action – Motion made by Supervisor Grabow to adjourn; seconded by Supervisor
Helms. Motion carried 5-0.
