BOARD OF SUPERVISORS MEETING
December 9, 2009 Minutes

I. CALL TO ORDER
A. Chairman Bartel called the meeting to order at 7:00 P.M.
B. Present:

IV. ADOPTION OF AGENDA
1. Action-Supervisor Grabow moved to adopt the agenda, seconded by Supervisor Sykora. Motion carried 5-0
V. REVIEW & APPROVE MINUTES
1. Action-Supervisor Sykora moved to approve the minutes, seconded by Supervisor Rogers. Motion carried 5-0
VI. PUBLIC HEARINGS
A. Ordinance 2009-06- An Ordinance Requiring Periodic Inspections for Backflow Prevention of Cross-Connections of Water Supply Provided by the Village of Grafton
1. Chairman Bartel opened the public hearing at 7:07 pm
2. No one wished to speak
3. Chairman Bartel closed the public hearing at 7:09 pm
VII. RESIDENT CORRESPONDENCE – PERSONS WISHING TO BE HEARD
A. Jack Heisler of 862 Falls Rd represents a group of citizens that are concerned with the flooding on the east end of Falls Road. This has been an ongoing problem; he appreciates the work that has been done but is concerned this will not handle the runoff from developments. Mr. Heisler would like to attend a staff meeting to discuss a long term plan with staff.
B. Larry Paque of 822 Falls Rd stated that he has water and ice over his driveway and he shares the same concerns as Mr. Heisler.
VIII. OLD BUSINESS
A. Update on Nuisance Violation-Dean Hoppe-701 Lakefield Rd-tax key # 06-033-06-006.00
1. Chairman Bartel explained that clerk Schmidt spoke with the landowner and he feels he has met all of the requirements.
2. Action-Supervisor Grabow moved to table this item for 30 days so that the Building Inspector and or Supervisors can do a final inspection of the property, seconded by Supervisor Sykora. Motion carried 5-0
B. Update on Green Valley Rd water stagnant water issue
1. The Town has received the POWTS maintenance report from the County.
2. Clerk Schmidt sent a letter to Leon Milbeck requesting permission/easement to do work on his property, but clerk Schmidt has not heard back as of yet.
3. Clerk Schmidt will contact the County to obtain the procedures for follow-up on parcels that show they are past due on maintenance.
4. No action taken
C. Line of Sight obstruction Ulao Parkway and HWY C
1. Supervisor Sykora visited the site and although the corner is not an ideal situation he did not see a large concern
2. The site will be visited during the annual road tour in 2010.
IX. NEW BUSINESS
A. Blank’s Crossing to Release Performance Bond
1. Engineer Lundeen informed the Board that the performance bond was to be posted for one year after the Town’s acceptance of the site. The Board accepted the sites in December 2008, there have been no issues and she recommends the Board release the bond to the developer.
2. Action-Supervisor Sykora moved that the Town releases the performance bond, seconded by Supervisor Rogers. Motion carried 5-0
B. Renew annual membership with Ozaukee County Economic Development
1. Engineer Lundeen explained that this is a separate line item in the budget, there just needs to formal action taken by the Board.
2. Action-Supervisor Grabow moved to renew the annual membership in the amount of $1500, seconded by Supervisor Schaefer. Motion carried 5-0
C. Presentation of the Urban Planning Grant project for discussion and possible action
1. Joel Brieske of Bonestroo provided the Board with a Construction Site Erosion Control Permit Application Packet, a reference manual and a post-construction stormwater runoff permit application packet.
D. Final Reimbursement for Larry’s Sewer and Water for the Green Bay Rd/Woodhaven Drainage Project
1. Action-Supervisor Sykora moved to table this item until the January meeting as there is still outstanding information that needs to be submitted, seconded by Supervisor Rogers. Motion carried 5-0
X. TOWN STAFF UPDATES
A. Engineer gave an overview of the road budget for the year
B. Attorney Hahn presented a letter regarding the Manternach berm.
XI. APPOINTMENTS OF COMMITTEES
A. Salary Review Committee
1. Supervisor Grabow moved to table this item until a list of possible members could be provided, seconded by Supervisor Sykora. Motion carried 5-0
B. Election Inspectors (Poll Workers ) - Jerry Kornetzke, Chief Inspector, Toni Moegenburg, alternate Chief Inspector, Romain Monarski, Joan Salger, Janice Strachota, Ruth Goeden, Arline Kaul, Joanne Levenick, Bonnie Bartel, Larry Tutewohl, Kay Tutewohl, , Jan Moegenburg, Sue LaGrange, Barbara Pierron, Dorothy Boyer, Donna Criplean, Gerald Irwin, Joan Tobianski, Jayne Hackbarth for a Two year term expiring December 31, 2011
1. Action-Supervisor Rogers moved to appoint the election Inspectors as presented, seconded by Supervisor Schaefer. Motion carried 5-0
XII. REPORTS – FOR INFORMATION, DISCUSSION AND ACTION
A. Chair
1. Chairman Bartel thanked the snow plow drivers for a job well done during this big storm.
B. Supervisors
1. Supervisor Grabow asked if the 2008 taxes have been paid on 918 Ulao Parkway (yes, they have been paid)
2. Supervisor Grabow stated there is a landscape business on CTH W (the second property to the south of Caliber) that he would like to have inspected by the Building Inspector as there may be CUP violations. Supervisor Grabow will follow-up with the Building Inspector.
3. Supervisor Grabow stated that the mowing and shouldering have been done too late and he feels that it is a waste of money.
4. Supervisor Schaefer asked if there has been any follow-up on the speed limit reduction request on Ulao. Chairman Bartel will contact the resident.
5. Supervisors discussed the resident request for dog park signage; no action will be taken at this time.

1. None
D. Presentation of Invoices
XIII. MISCELLANEOUS ITEMS DEEMED PERTINENT AS ALLOWED BY LAW
1. Chairman Bartel reviewed the chain of command for the Town’s staff.
XIV. CONVENE INTO CLOSED SESSION – PURSUANT TO SECTION §19.85(1) (G), WIS. STATS, TO CONFER WITH THE TOWN’S LEGAL COUNSEL REGARDING PERSONNEL MATTERS AND LEGAL STRATEGY TO BE CONSIDERED BY THE TOWN BOARD REGARDING POTENTIAL LITIGATION CONCERNING THE DENOW LANDFILL.
1. Action-Supervisor Grabow moved to convene into closed session at 8:30 pm, seconded by Supervisor Sykora. Motion carried 5-0
XV. RETURN TO OPEN SESSION – PURSUANT TO WIS. STATS. §19.85 (2) FOR ADDITIONAL DISCUSSION, EVALUATION, AND PREPARATION OF LEGAL ACTION REGARDING THE DENOW LANDFILL AND PERSONNEL MATTERS.
1. Action-Supervisor Grabow moved to reconvene to open session at 9:37 pm, seconded by Supervisor Rogers. Motion carried 5-0
XVI. ADJOURN
1. Action-Supervisor Schaefer moved to adjourn, seconded by Supervisor Sykora. Motion carried 5-0
