BOARD OF SUPERVISORS MEETING
December 8, 2010 Minutes
I. CALL TO ORDER
1. Chairman Bartel called the meeting to order at 7:00 P.M.

II. ASSURANCE OF PROPER NOTICE
1. Town Clerk Jessica Schmidt assured the meeting was noticed properly
III. PLEDGE OF ALLEGIANCE TO THE FLAG
IV. ADOPTION OF AGENDA
1. ACTION: Supervisor Sykora moved to approve the agenda as presented, seconded by Supervisor Schaefer. Motion carried 5-0
V. REVIEW & APPROVE MINUTES
1. ACTION: Supervisor Grabow moved to approve the minutes of the November meeting, seconded by Supervisor Sykora. Motion carried 3-0, with Nancy Rogers and Steve Schaefer abstaining
2. ACTION: Supervisor Grabow moved to approve the minutes of the September 29 special meeting, seconded by Supervisor Sykora. Motion carried 4-0, with Nancy Rogers abstaining
VI. PUBLIC HEARINGS
A. Ordinance 2010-09 Amending Title 4 – Public Works; Chapter 4 – Driveways, Title 7 - Licensing and Regulation; Chapter 7 - Building Construction, And Title 9 – Land Use Regulation; Chapter 1 – Zoning Of the Code of Ordinances, Town Of Grafton, Wisconsin (Concrete Driveways)
1. Action-Chairman Bartel opened the public hearing at 7:07 pm
2. No one wished to speak
3. Action-Chairman Bartel closed the public hearing at 7:08 pm
4. Supervisor Grabow asked how the Town is going to know what driveways are pre-existing and which are new. The Board agreed to perform an inventory of the existing concrete driveways at the annual road tour.
5. Action-Supervisor Sykora moved to approve Ordinance 2010-09, seconded by Supervisor Rogers. Motion carried 5-0
B. Ordinance 2010-10 Amending (Reducing) the Speed limit on Green Bay Rd
1. Action-Chairman Bartel opened the public hearing at 7:14 pm
2. Scott Orten asked if the Town contacted the Sheriff’s department to see how often they would be able to patrol the area, did the Town ever contact them? Chairman Bartel explained that the Town did in fact contact the sheriff’s department and they did patrol the area at least once. This will be a further discussion in the near future as to how the Town would like to better patrol the area.
3. Donna Fix-724 Green Bay Rd presented correspondence form 3 neighbors that were not available to attend the meeting tonight who are in favor of the speed limit reduction.
4. Action-Chairman Bartel closed the public hearing at 7:16 pm
5. Supervisor Grabow stated that according to the accident report that the Town received from the Sheriff’s department this stretch of road seems to be one of the most dangerous roads in Ozaukee County and it bothers him that the Sheriff’s Department is not able to have someone patrol that area at least once a week. Chairman Bartel explained that it is an unfortunate staffing issue that they have in their department.
6. Action-Supervisor Sykora moved to approve Ordinance 2010-10 to reduce the speed limit on Green Bay Rd from 35 mph to 25 mph from Chateau Park to Lakefield Rd, seconded by Supervisor Schaefer. Motion carried 5-0
C. Ordinance 2010-11 revisions to the Town of Grafton's Land Division Code in response to revisions to Wis. Stat. 236 regarding Platting Land
1. Attorney Hahn stated that this is just updating the Town’s Code so that it matches the changes that the State of Wisconsin made recently.
2. Action-Chairman Bartel opened the public hearing at 7:19 pm

4. Action-Chairman Bartel closed the public hearing at 7:20 pm
5. Action-Supervisor Rogers moved to approve Ordinance 2010-11 as presented, seconded by Supervisor Grabow. Motion carried 5-0
VII. RESIDENT CORRESPONDENCE – PERSONS WISHING TO BE HEARD
1. Brad Babor 223 Aqua View Dr informed the Board that the hunting/firearms discharge issue has gotten worse since he last met with the Board in 2008. He has contacted the Sheriff’s department regarding incidents that have been occurring recently and he was told that there is nothing that the sheriff’s department can do because they were not on Mr. Babor’s property and the Town ordinance was never adopted by the sheriff’s department.
2. When this issue came up in 2008 it was agreed that the hunters would shoot along the length of the river and not toward any residences, however, this is not happening. When asked to provide copies of their firearms discharge permits, the hunters stated that they did not need one according to the DNR. One of the hunters was at the meeting in 2008 and agreed to the terms that were discussed that evening. He said that he did not need to provide the permit, or even have one and that Mr. Babor should call the DNR.
3. The Town will investigate if it is possible to extend the no firearms discharge area and will address this at a future meeting.
VIII. OLD BUSINESS-NONE
IX. NEW BUSINESS
A. 2010 Drainage Project Update
1. Green Valley Rd-DNR requested additional information regarding the dredging on the site. The information has been submitted and is awaiting DNR review
2. Falls Rd-documents have been completed and will be dispersed in the spring when the project will be completed
3. Edgewater drainage easement-nothing to report
4. Supervisor Grabow asked what the resident is looking for regarding the easement. Chairman Bartel stated that the homeowner wanted to discuss the issue with his wife and he would then talk with Town.
B. 2011 Road Maintenance Contract
1. Supervisors went through the contract line by line and agreed on the procedures that were to be included.
2. Action-Supervisor Grabow moved to approve the contract as discussed, seconded by Supervisor Sykora. Motion carried 5-0
C. Pay request by Grade Tech Pavers for the Multi-Use Trail Project, Phase 2
1. Action-Supervisor Sykora moved to approve the pay request in the amount of $3,036.30 and holding a retainage until spring when the final walk through can be performed, seconded by Supervisor Schaefer. Motion carried 5-0
D. Recommendation by Plan Commission to amend the code in the in the A-1 agricultural district conditional uses to allow for viticulture
1. ACTION: Supervisor Grabow moved to direct staff to draft an amendment to the code to allow for vitaculture/viniculture (or appropriate terminology) as a conditional use in the A-1 agricultural district, seconded by Supervisor Sykora. Motion carried 5-0
X. TOWN STAFF UPDATES
1. Planner Schaefer stated that Ozaukee County has released their Comprehensive Plan on DVD. Andrew Struck is willing to give a presentation to any municipality that is interested. Planner Schaefer will view the DVD and give an update to the Board.
2. Engineer Lentz stated that the Village of Grafton Falls road project has been put on hold until 2013.
3. Clerk Schmidt stated that tax Bills are waiting to be printed.
4. Clerk Schmidt is eagerly awaiting the statement of taxes from the state so that can be completed and turned into the County Treasurer and State by December 20th.
5. Clerk Schmidt stated that the auditors were in the Town Hall yesterday and they have completed their field work and will be preparing the final report for the Town shortly. There were a few items that came up that were not addressed in the agreement so Clerk Schmidt directed the auditors to proceed with those items.
XI. APPOINTMENTS OF COMMITTEES-NONE
XII. REPORTS – FOR INFORMATION, DISCUSSION AND ACTION
A. Chair
1. The Town will have to look into contracting with off duty police officers to enforce Town ordinances.
2. Chairman Bartel took Town Hall staff out to lunch at Edgewater Golf Course.
B. Supervisors
1. Nancy Rogers announced that she filed her non-candidacy papers with the Town Clerk. She would like to spend more time with her new Grandson and family. She has truly enjoyed working with everyone in the Town.
2. Supervisor Grabow stated that he found out what portion of Maple Rd the Town controls; it is north end ½ mile from Cedar Sauk and ½ mile from the south end, which is Cedar Creek. The Town of Cedarburg has control of the other areas.
3. Super visor Grabow stated that the Town should form a financial investment subcommittee formed of Town Residents.
