BOARD OF SUPERVISORS MEETING AGENDA

I. CALL TO ORDER

II. ASSURANCE OF PROPER NOTICE
1. Clerk Schmidt assured the meeting was properly noticed
III. PLEDGE OF ALLEGIANCE TO THE FLAG
IV. REVIEW AND ADOPT AGENDA
1. Supervisor Grabow moved to adopt the agenda as presented, seconded by Supervisor Sykora. Motion carried 5-0
V. APPROVE MINUTES FROM PREVIOUS MEETING
1. Supervisor Helms moved to approve the minutes of the previous meeting, seconded by Supervisor Sykora. Motion carried 5-0
VI. PUBLIC HEARINGS - OPPORTUNITY WILL BE AFFORDED TO ALL INTERESTED PARTIES IN BEING HEARD CONCERNING: NONE
VII. RESIDENT CORRESPONDENCE/PERSONS WISHING TO BE HEARD
A. Paul Gutelius-Base 2/Riverwood Acres, LLC-Request for Invoice reduction
1. Mr. Gutelius stated that his professional staff contacted the Town’s professional staff asking for clarification on the punch list/staff report for his submittal of staff review of punch list items but never received an answer to his questions.
2. Planner Schaefer stated that planner Allewalt reviewed the submittal, and once she noticed that not all items on the punch list were addressed, she contacted the Clerk to ask if the applicant would like to withdraw the application or if he would like staff to continue their review and generate another punch list.
3. Clerk Schmidt stated that protocols were followed by staff as outlined in the policy and procedure manual. Once the submittal was deemed incomplete, the applicant was given the option to continue the review or withdraw the submittal.
4. Action-Supervisor Rogers moved to deny the invoice reduction request, seconded by Supervisor Sykora. Motion carried 5-0
B. Sandra Dempsey agent for Beach Grass, LLC-Request for invoice reduction
1. Clerk Schmidt stated that the applicant granted an easement to the Town for the multi-use trail. The applicant is requesting review fees for this easement be paid for by the Town.
2. Action-Supervisor Grabow moved to approve the invoice reduction and apply the multi-use trail easement review fees to the open space budget, seconded by Supervisor Rogers. Motion carried 4-1 with Supervisor Helms dissenting
C. Possible Code Violation complaint-Craig Kaminski-1948 N. Green Bay Rd
1. Action-Supervisor Supervisor Helms moved to direct the Clerk to issue the 1st notice of violation, seconded by Supervisor Sykora. Motion carried 5-0
VIII. OLD BUSINESS
A. Update on Alleged Nuisance Violation –Paul Doblinger-1930 Edgewater Dr-tax key # 06-054-0040.000
1. Action-Supervisor Helms moved to grant Mr. Doblinger an extension to April 24, 2009 to bring the nuisance into compliance, seconded by Supervisor Grabow. Motion carried 5-0
IX. NEW BUSINESS
A. Additional Escrow Requirement, GZA, Town Environmental Consultant for Staff Review of Punchlist items
1. Clerk Schmidt stated that due to the unique environmental issues on this property, the Town is requesting additional escrow to cover the Environmental review costs and additional legal review of the application in the amount of $2,500.
2. Action-Supervisor Grabow moved to approve the $2,500 additional escrow requirement, seconded by Supervisor Sykora. Motion carried 5-0
B. Nuisance Violation-Kelly Berger-1517 Green Valley Rd.-tax key # 05-05501-13.000
1. Mr. Berger proposed to install a temporary shelter to cover his vehicle while he is working on it.
2. Supervisors would like further information from the building inspector prior to taking action.
3. Action-Supervisor Grabow moved to table this agenda item until the May 2009 Supervisor’s meeting, seconded by Supervisor Helms. Motion carried 5-0
C. Draft presentation of 2009 Pavement Maintenance Program
1. Engineer Lundeen presented a draft of the 2009 pavement maintenance program with and will appear before the Board for possible adoption at the May 2009 Supervisor’s meeting.
2. Action-At 8:09 pm Chairman Bartel recused himself, as he is the applicant. Chairman Bartel stepped down and Supervisor Sykora took the position of Chairman.
D. Lester and Bonnie Bartel-Lebon Estates- Tax Key # 06-071-0011.000-Rezone from A-1 to R-2
1. Action-Supervisor Helms moved to approve the rezone from A-1 to R-2, seconded by Supervisor Rogers. Motion carried 4-0
E. Lester and Bonnie Bartel-Lebon Estates- 1833 E River Rd-Tax Key #06-071-0011.000-Minor Land Division
1. Action-Supervisor Helms moved to approve the minor land division, seconded by Supervisor Grabow. Motion carried 4-0
2. Action-At 8:24 pm Chairman Bartel returned to his seat as Chairman.
F. Ordinance 2009-01-Proposed text amendments to the B-1 Design Standards and 9.1.5.01 Parking Requirements
1. Action-Supervisor Sykora moved to approve the text amendments, seconded by Supervisor Helms. Motion carried 5-0
G. Request from the Open Space Commission to apply for a Land Stewardship Grant for the construction of the first section of the Multi-use trail
1. Action-Supervisor Rogers moved to have staff apply for a Land Stewardship Grant, secondedd by Supervisor Sykora. Motion carried 5-0
X. TOWN ENGINEER UPDATE
1. None
XI. APPOINTMENTS OF COMMITTEES- NONE
XII. REPORTS – FOR INFORMATION, DISCUSSION AND ACTION
A. Chair
1. Commend Town staff for a very well run election, all results were in early and all votes were accounted for.
2. This is Supervisor Helms’ last Supervisors meeting, and would like to commend him for his years of service and his dedication to the Town.
B. Supervisors
1. Supervisor Grabow stated that the Town will be receiving a credit on the next Highway bill for the culvert on HWY C.
2. Supervisor Grabow informed the Board about an email that was sent out by the County Health Department about well testing. Clerk Schmidt will post the information on the website and have handouts available at the annual meeting.
3. Supervisor Grabow asked if the Town has a map that shows all of the road reservations in the Town. The Register of Deeds has that information.
C. Clerk
1. Clerk Schmidt thanked all of the poll workers for their hard work on a successful election day.
2. Recycling Grant Reduction due to State Budget Shortfall (approx imate reduction of $1,700)
3. Clerk Schmidt has received a resident complaint form for the Hoppe roperty South of Lakshore Rd.
4. Bonnie Bartel put the outside hanging baskets together and did a wonderful job. The landlord is paying for the flowers.
