BOARD OF SUPERVISORS MEETING
April 14, 2010 Minutes
I. CALL TO ORDER
1. Chairman Bartel called the meeting to order at 7:00 P.M.
2. Present:
Chairman Lester A. Bartel, Jr.

II. ASSURANCE OF PROPER NOTICE
1. Town Clerk Jessica Schmidt assured the meeting that the Agenda was noticed properly
III. PLEDGE OF ALLEGIANCE TO THE FLAG
IV. ADOPTION OF AGENDA
1. ACTION: Supervisor Grabow moved to accept Agenda, seconded by Supervisor Sykora. Motion carried 4-0
V. REVIEW & APPROVE MINUTES
A. Approve the minutes from the previous meeting
1. ACTION: Supervisor Rogers moved to accept the minutes of the March meeting, seconded by Supervisor Sykora. Motion carried 4-0
B. Amend the February 10, 2010 minutes to include the motion on the public hearing for the fee schedule
1. ACTION: Supervisor Sykora moved to amend the February 10, 2010 minutes to include motion on public hearing for Fee Schedule, seconded by Supervisor Rogers. Motion carried 4-0
VI. RESIDENT CORRESPONDENCE – PERSONS WISHING TO BE HEARD
1. Clerk Schmidt presented written correspondence from a resident requesting a speed limit sign and “watch children” sign on Hillcrest Rd. This item will be placed on the May agenda for discussion and possible action.
VII. OLD BUSINESS
A. Rich Wieland-Woodland Shores-update on plan of reparation
1. Rich Wieland informed the Board that he would have a plan in roughly 4-6 weeks.
2. ACTION: Chairman Bartel moved to extend the deadline for submittal of a plan of reparation until the June 2010 Board of Supervisors meeting, seconded by Supervisor Sykora. Motion carried 4-0
B. Update on Nuisance Violation-Steven Smith-1831 HWY W-tax key# 06-007-13-005.00
1. The property owner stated that they have been working on the list of items that was submitted.
2. Supervisor Grabow visited the site and made a list of items that need to be addressed, but due to the extent of items, the list is not all inclusive. Upon further inspections, the Town may find additional items that need to be addressed. The property owner stated that she understands that the list is on-going and is willing to work with the Town.
3. The property owner stated that a silver car continues to stop by their property to take photos. Chairman Bartel explained that this is not the Town of Grafton.
4. ACTION: No action taken
VIII. NEW BUSINESS
A. Resolution 2010-05-A resolution of the Town of Grafton Board of Supervisors designating the Ozaukee press as the site for publishing legal notices for the Town of Grafton
1. ACTION: Chairman Bartel moved to approve Resolution 2010-05 designating the Ozaukee Press as the official newspaper of the public record for the Town of Grafton, seconded by Supervisor Sykora. Motion carried 4-0
B. Road Budget overview and prioritization
1. Supervisor Schaefer joined the discussion via telephone.
2. Supervisor Grabow would like to see the higher traveled roads addressed before working on less traveled roads.
3. ACTION: Supervisor Sykora moved to approve the Lakeshore Road project alternate A, and prioritizing additional Town projects, seconded by Supervisor Rogers. Motion carried 4-1, with Supervisor Grabow dissenting
4. Supervisor Schaefer left the discussion.
5. Action-Supervisor Rogers moved to instruct staff to submit a Notice to Proceed with prioritized projects to the Ozaukee County Highway Department, seconded by Supervisor Sykora. Motion carried 4-0
C. Bid award for north non-motorized boat launch
1. ACTION: Supervisor Sykora moved to award the project to Henry R. Marohl as presented, seconded by Supervisor Rogers. Motion carried 4-0
D. Bid Award for Lakeshore Road phase II project
1. ACTION: Supervisor Sykora moved to award the Lakeshore Rd project base bid in the amount of $138,816.25 to Payne and Dolan, seconded by Supervisor Grabow. Motion carried 4-0
E. Presentation of potential revisions to Firearms Discharge Ordinance
1. Attorney Hahn discussed potential changes to the Firearms discharge ordinance including clarification of the requirement for a property owner to obtain a permit if he discharges a firearm is on his/her own land.
2. Discussion took place about striking the 15 acre requirement to obtain a permit.
3. ACTION: Supervisor Grabow moved to instruct staff to make the amendments to the code and present tem for adoption at a future meeting, seconded by Supervisor Sykora. Motion carried 4-0
IX. TOWN STAFF UPDATES
1. Planner Schaefer informed the Board that the next STH 32/V workshop will be held on April 20, 2010. Mike Rambousek, Director of Planning & Development in the Village of Grafton and Randy Tetzlaff, Director of Planning & Development in the City of Port Washington will attend and offer their feedback.

XII. CONVENE INTO CLOSED SESSION – PURSUANT TO WIS. STAT. §19.85(1)(G), TO CONFER WITH THETOWN’S LEGAL COUNSEL REGARDING LEGAL STRATEGY TO BE CONSIDERED BY THE TOWN BOARD WITHRESPECT TO LITIGATION WITH THE CITY OF MEQUON
1. Action-Supervisor Grabow moved to adjourn into closed session, seconded by Supervisor Sykora. Motion carried 4-0

A. Action-Supervisor Rogers moved to return to open session, seconded by Supervisor Sykora. Motion carried 4-0
XIV. ADJOURN
1. Action – Motion made by Supervisor Grabow to adjourn, Seconded by Supervisor Sykora. Motion carried 4-0
